These Terms and Conditions (“the Terms and Conditions”) govern you (“the User”) use of the The Rooibos Online Store (“Provider”) website located at the domain name http://www.rooibosstore.co.za (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.

 

Independent Distributor & Consultants

We at The Rooibos Online Store clearly indicate on our Website www.rooibosstore.co.za that we are Independent Distributors, thus any Annique Independent Distributor & Consultant that purchase on our website will be seen as a "Client" and therefor no refund will be paid back to a distributor or consultant that in-correctly ordered on our website instead of the Annique Portal for Consultants / Distributors

Electronic Communications
By using this Website or communicating with the Provider by electronic means, the user consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

E-Commerce & Privacy
The Website http://www.rooibosstore.co.za sells various products online.  The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website. 

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.  Credit card details are not kept by the Provider under any circumstances.

The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

The Provider will supply all goods to the delivery company in good order. The Provider will not be held liable for the condition of goods arriving at the User’s chosen delivery address.

Credit Card Acquiring – Payment Gateway
Credit Card Transactions are acquired by Greg S PayFast (Pty) Ltd, a registered systems operator and payment gateway in South Africa.  Card Holders may go to www.payfast.co.za to view PayFast’s security policy.

Specials on our website

All orders must be paid on the date in full before a special closes, EFT payment received after a special closes, will be cancelled and refunded

 

Beaute Month End, Dash Deals, Weekend Specials, One Day Only Specials and Black Friday Specials

The above specials will run till the date mentioned on the product listing till 21h00 on that specific day. All specials and products are based on while stock last, some products are only valid as promotional item and therefore may be sold out and discontinued without notice. Should any order be placed for item/s after 21h00 stipulated and paid in full at normal retail price, a refund for difference between Retail Price and Special price will be done afterwards to your bank account, a request for this will be done per e-mail only and a status update of your order will change to partial refunded, after the refund has been paid into your bank account. One Day Only Specials may be sold out quickly, therefore it's first come first serve basis. Black Friday items may not be reserved should different items fall on different dates. Black Friday items will incur delivery fee per order placed and cannot be combined to be shipped out as the order process are automated. No item on promotion may be reserved to be paid later. Abandoned cart is valid while stock last, the special price will only be valid till when the special closes. Abandoned cart does not reserve stock nor your order.

Refund and Return Policy
The provision of goods and services is subject to availability. In cases of unavailability, the provider will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10% charge for administration costs. 
The Provider reserves the right to cancel an order for which payment has already been received.  This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards.  Should the Provider exercise this right, the User will receive a full refund with no deductions.

When placing your order, ensure you choose the correct items and address is correct, because once your order is placed, we can unfortunately not cancel your order as this is all part of an automated system and your order is already in the process and will be delivered by the courier to the chosen delivery address or counter collection at PEP, Postnet or TekkieTown. The fulfillment of the order ends when it arrives at point of delivery may that be home- or work address, or counter collection. From this point onwards, if parcel is not accepted it will be returned to Annique Head Office and incur courier costs. Courier may re-try to deliver your parcel before returning the parcel to Annique Head Office.

 

If your delivery address is incorrectly provided to us when placing your order, your order will still be couriered to the address given when placing your order, it will then be returned and incur courier costs. When selecting counter collections ( PEP, Postnet or TekkieTown ) we asked that you add your chosen store by typing it in the Order Comments section when placing your order. If you however do not select a store on your own, the nearest store to your address will be selected and order fulfilled.

 

Tracking number is provided on all orders, ensure that when you are expecting your parcel that you are available upon delivery and have your phone with you as the courier may phone you if they have challenges delivering your parcel. Note : sometimes they will phone from an unknown contact number. The courier companies have their own route and procedures they follow, we will not be able to provide the time of delivery. Should your parcel be returned to Annique Head Office and you wish to receive your undelivered parcel again, it will be at your own cost and unfortunately special offers will be forfeited if they are no longer available.

 

When you are ordering your parcel and you choose a counter collection for PEP, ensure that your parcel is collected within seven days as this will also result in your parcel being returned. When you are ordering your parcel and you choose a counter collection with Postnet, ensure that your parcel is collected within 10 days as this will also result in your parcel being returned.

When receiving your parcel from the courier or counter collection, ensure that you check that the parcel is not damaged, has no visible leakages and the Annique security tape and the white strapping on the parcel was not tampered with. If any of these signs are noticeable, don't sign or accept the parcel from the courier. Please inform us immediately at info@rooibosstore.co.za for us to arrange for a new parcel to be sent to your as soon as possible.

Once you sign for your parcel, you are signing that you have received your parcel in good condition and Annique or the courier company can unfortunately not be held liable for the damages of the parcel

Courier Parcel Tracking - Track your own parcel directly with the courier should you need further information and are unable to obtain the information with the tracking number provided. Note : Please allow 2-3 working days for delivery to main centres and 4-5 working days for regional centres and outlying centres

Please allow 2-3 working days for Postnet deliveries to main centres and 3-5 working days for PostNet deliveries to regional areas

Please allow 4-5 working days for Skynet / PEP deliveries.

Updating of these Terms and Conditions
Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Copyright and Intellectual Property Rights
Provider provides certain information at the Website. Content currently or anticipated to be displayed at this Website is provided by Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Musical Works, Artistic Works, Sound Recordings, Cinematograph Films, Sound and Television Broadcasts, Program-Carrying Signals, Published Editions and Computer Programs (“the Content”). All such proprietary works, and the compilation of the proprietary works, are copyright the Provider, its affiliates or subsidiary, or any other third party owner of such rights (“the Owners”), and is protected by South African and international copyright laws. The Providers reserve the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any times and without notice. All rights in and to the Content is reserved and retained by the Owners. Limitation of liability
The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof.

Privacy:  casual surfing
The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Provider uses this information to determine use of the Website, and to improve Content thereon. Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.

Choice of Law
This Website is controlled, operated and administered by Provider from its offices within the Republic of South Africa. Access to the Website from territories or countries where the Content or purchase of the products sold on the Website is illegal is prohibited. The User may not use this Website in violation of South African export laws and regulations. If the User accesses this Website from locations outside of South Africa, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Witwatersrand High Court in the event of any dispute. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to the use of the Content and this Website.
